Sister allegedly assaulted when she tries to get drunk brother inside the house

Pago Pago, AMERICAN SAMOA — On July 25, 2025, a woman called the Tafuna Police Substation (TPS) requesting assistance regarding her brother who was allegedly causing a disturbance and threatening to hurt her and her mother.

The suspect was later arrested and charged with Count 1: Private Peace Disturbance (DV), a class C misdemeanor punishable by imprisonment for up to fifteen days, a fine of $300, or both imprisonment and fine.

The defendant was held without bail.

According to the court affidavit, on July 25th, at around 8:19 p.m, a woman (hereinafter reporter/ victim #1) reported a disturbance regarding her brother, Douglas Malivao (hereinafter suspect).

The reporter alleged that her brother was heavily intoxicated and yelling profanities in Samoan at her, her husband and their mother (victim #2). She also stated that the suspect made verbal threats to assault her.

The reporter further explained that the incident started when the suspect stood in front of their patio. She advised him to go inside and rest because he was intoxicated. However, the suspect became verbally aggressive and stated that “it was no one’s business to tell him what to do” and he refused to listen.

Her husband then exited the residence and asked the suspect to go rest but he continued to yell out profanities. In an attempt to de-escalate the situation, the reporter stated that her husband returned to their house without further confrontation.

The reporter continued that moments later, their mother approached the suspect and urged him to rest. However, the suspect responded with profanities and also threatened to hit their mother.

Following this, their mother instructed her to contact the police for assistance.

Police officers responded to the scene and upon arrival, the officers met with the reporter and her mother. They briefed the authorities again regarding the situation and informed them that this was a recurring issue whenever the suspect was under the influence of alcohol.

The officers were directed to a small shack located nearby, where the suspect resides. Upon arrival at the shack, the suspect was located along with his minor daughter. The officers requested for the suspect to step outside to which he complied without incident.

The suspect was apprehended and taken to the TPS for processing.

Upon arrival at the station, the suspect was Mirandized to which he acknowledged but refused to sign. The suspect also declined to provide any statement regarding the incident.

He was later booked and transported to the Tafuna Correctional Facility to await the next available sitting of the District Court.

The suspect is identified as a 47-year-old citizen of Samoa.
