Pago Pago, AMERICAN SAMOA — Andrew Agasiva is facing charges related to two separate incidents, both occurring on the same day, December 7, 2024. Two affidavits were issued concerning the two incidents, with bail set at $2,000 in each affidavit.
Agasiva’s initial arrest occurred after a male individual (later identified as the victim) contacted the TPS and reported that someone was causing a ruckus at his house.
According to the court affidavit, on December 7th, police officers responded to a call about the alleged disturbance and made initial contact with the victim who briefed them on what happened.
The victim stated that the defendant threw a brick at his truck, shattering the windshield and took off.
The officers located the defendant at a house nearby the victim’s house. The defendant was apprehended and he appeared to be intoxicated.
He then resisted arrest by pulling his hands away. The officers were able to subdue him and placed him inside the police unit. The officers also took photos of the damage to the victim’s vehicle.
The victim verbally stated that he was inside watching his television when he heard a loud noise coming from outside his house. The victim explained that he exited his house and saw the defendant outside next to his vehicle and he discovered that the defendant had thrown a brick at his vehicle.
The first set of charges Agasiva is facing is:
Count 1: Private Peace Disturbance (DV), a class C misdemeanor punishable by imprisonment for up to fifteen days, a fine of $300 or both; and,
Count 2: Property Damage in the Second Degree, a class A misdemeanor punishable by imprisonment for up to one year, a fine of $1,000, or both.
The second affidavit relates to Agasiva after his arrest, and during the booking process was found to have in his possession a cut up straw containing crystalline substances.
He is charged with Count 1: Unlawful Possession of Controlled Substances, a felony punishable by a fine of not less than $5,000. and not more than $20,000, a term of imprisonment ofnot less than 5 years not more than 10 years, or both imprisonment and fine.
According to the authorities, when they detained the suspect, he had in his possession a black sling bag. Agasiva was transported to the TPS and was booked. During the booking process, officers discovered inside the sling bag some cash —$43.00, a smartphone, a lighter, and a red cut up straw containing a crystalline substance.
When the suspect was asked about the items, Agasiva told the officers that the sling bag and its contents were his except for the red cut up straw. The suspect stated he had no knowledge of such an item.
The items were transferred over to the Vice & Narcotic Unit where they conducted a test of the crystalline substances inside the red cut up straw using a Methamphetamine Test Kit. The test yielded a positive result for Methamphetamine.
Evidence was documented and later turned into the evidence custodian.
The suspect was Mirandized and refused to make a statement.
He was booked and confined at the Tafuna Correctional Facility awaiting the next available sitting of the District Court.
The defendant is identified as a 38-year-old U.S National.
