Pago Pago, AMERICAN SAMOA — A 36-year-old male residing in Fagaalu was arrested on December 4, 2023, after it was reported that he was making unreasonable noises, and sitting fully naked at a bus stop in front of his residence.
Jared Kupu was charged with the following:
Count 1: Public Peace Disturbance - a class B misdemeanor punishable by imprisonment for six months, a fine of $500, or both.
Count 2: Indecent Exposure - a class A misdemeanor, punishable by imprisonment for up to one year, a fine of $1000, or both.
Count 3: Indecent Exposure - a class A misdemeanor, punishable by imprisonment for up to one year, a fine of $1000, or both.
Count 4: Endangering the Welfare of a Child - a class A misdemeanor, punishable by imprisonment for up to one year, a fine of $1000, or both.
Bail was set at $1000.
On December 4, 2023, the Fagatogo Police Station (FPS) received a call from the defendant’s mother regarding her son making unreasonable noises at the bus stop in front of their residence.
Officers responded to the matter and when they arrived at the scene, they saw the suspect sitting at the bus stop across the street.
The mother was interviewed and verbally stated, Jared’s been making unreasonable noises in front of their house at the public bus stop across from their residence because she chased him out of her house.
“He would swear at people he encountered at the bus stop in the previous week until today.”
She further stated that she “observed Jared sitting at the same bus stop, fully naked and exposed while people passed by on the road.”
She presented the officers with a picture that she took on her phone for proof.
The mother explains that earlier in the day when she was not home, at around noon, the defendant “came by the house and showered fully naked (exposing his private parts) outside of the house, while her 25 and 35 year old daughters along with her 1 year old granddaughter were at the house.”
When she returned home and saw that her son was back at the house, she chased him away and told him to leave her property.
According to the affidavit, the suspect allegedly went back to the bus stop and yelled profanities at his mother more than 10 times and that was when she contacted the police station for assistance.
The mother also said that Jared has “been threatening her at times with a kitchen knife and has been telling her that there will be a time he will do something to her and her daughters.”
After speaking with the mother, the officers transported Jared to the FPS for further investigation.
When arriving at the FPS, Mr. Kupu was Mirandized but refused to cooperate.
He was booked and confined at the Tafuna Correctional Facility to await the next sitting of the District Court.
