Speaker takes issue with reasons for ban on testimony at House hearings

Pago Pago, AMERICAN SAMOA — Speaker of the House Savali Talavou Ale is voicing his concern over Gov. Lemanu P. S. Mauga’s reasoning when he recently — albeit briefly  —barred testimony by directors, managers and admin personnel from testifying before House hearings. 

 In an April 10 letter to the governor, the Speaker acknowledges that the matter has been discussed between the two leaders, however, he has issues with some of the reasons for the ban.

 “While we have since communicated regarding this matter, I am responding to your communiqué as I take issue with some of its content.

“Since the establishment of the Territorial government, our branches have remained relatively diplomatic through the observance of a high degree of deference and mutual respect founded in both culture and law.”

Savaii also reminded the governor that the “principles of checks and balances exist to equalize authority in governing and the legislature provides its checks through a thorough examination of the executive and is not only authorized to scrutinize, it is its legal and moral obligation.”

 “Sadly, this authority was impeded by your memo No. 072-23 and I need not remind you that this is a dangerous precedent that neither of our branches should set and I ask that we have formal communication prior to taking such extraordinary measures,” Savali continued.

The Speaker also mentions that the reason for not issuing subpoenas for appearances is because the requests of the House committees have always been answered. He also attributes the open communications and high level of cooperation between their branches. In addition, he states that they will continue to maintain that the process currently employed is sufficient for House hearings.

The letter states that “I am grateful for the lifting of the order for witness appearances” in the week remaining in the First Regular Session as there are still measures by both the Fono and the Administration that require attention.

 “Our branches have worked tirelessly to dispense with this session’s legislative agenda and I commend all involved in its success. The session in July is sure to bring just as many challenges and I have every confidence we will find similar successes as we do the work of the people, and in the meantime, let us join in the spirit of celebration as we commemorate the 123rd Flag Day celebration for the Territory,” the Speaker concuded.
