Two men arrested after they refuse to leave nightclub at closing time

Pago Pago, AMERICAN SAMOA — On June 28, 2025, the head security guard of a local nightclub called the Tafuna Police Substation regarding two men, who were causing a disturbance at the nightclub.

The two men were later arrested and charged with:

Count 1: Public Peace Disturbance, a class B misdemeanor punishable by imprisonment for up to six months, a fine of up to $500, or both; and,

Count 2: Trespass, a class B misdemeanor punishable by imprisonment for up to six months, a fine of up to $500, or both.

Bail was set at $1,500 for Desmond Niko (suspect #1); and $500 for Ioane Fa’amata (suspect #2).

According to the court affidavit, on June 28th, TPS received a call from the head security of the Flames nightclub who reported two intoxicated male individuals causing a disturbance. The individuals were yelling profanities in Samoan and refused to vacate the premises despite the bar being closed.

Police officers responded to the call and upon arrival at the scene, they observed two men exhibiting aggressive and disruptive behavior. One of the individuals, identified as Desmond Niko (suspect #1) appeared heavily intoxicated.

According to statements from the security personnel, Niko made verbal threats and stated that he was in possession of a firearm and would use it to shoot everyone present in the area. Niko continued to act belligerent and refused to comply with the security guard’s directive to leave the premises.

Suspect #2, Ioane Fa’amata was also intoxicated and was yelling profanities. Fa’amata became aggressive towards Niko, allegedly due to the threats made by Niko. He attempted to engage in a physical altercation with Niko.

Both men refused to vacate the premises which prompted the officers to detain them. They were transported to the TPS for further investigation.

During transport and upon arrival at the station, Niko became increasingly hostile. He threatened the officers and stated multiple times that he had a gun and would shoot them upon release. Niko demanded that his cuffs be removed so he could physically assault the officers.

Fa’amata also displayed aggression and requested to be placed in the same room with Niko so he could physically confront him. He also stated that once he gets inside the Tafuna Correctional Facility (TFC), he plans to assault Niko.

Both suspects refused to provide statements and due to their threatening behavior and continued aggression, they were both booked and transported to the TFC to await the next available sitting of the District Court.
