According to the court affidavit, on July 27th, at about 1:30 a.m., Sammy Mikaele and Jacob Sala, along with three other unidentified men allegedly assaulted a man (referred to as the victim) in front of the McDonald’s in Tafuna.
The investigation revealed that Mikaele threw a beer bottle at the victim’s head, followed by several punches to his face and body. It was also reported that Sala jumped in and threw several punches until the victim was unconscious.
Upon arrival at the scene, police observed the victim lying on the ground unconscious with his face and head covered in blood.
The officers immediately carried him into the police unit and transported him to the EMS base for urgent care of his injuries. The victim was later transported to the LBJ Medical Center for further treatment.
Authorities proceeded back to the scene, where they met up with a man
(later identified as the witness) — an employee of McDonald’s, who witnessed the incident. According to the witness, he was on the other side of the parking lot when he was sent to go to the drive-thru side. As he was running towards the drive-thru side, he saw a group of men chasing the victim towards the parking lot.
He stated that he saw the victim fall to the ground and the guy with a yellow tank top (Mikaele) caught up to the victim and threw a bottle of beer where it hit the victim on the head. The witness also said that when the rest of ‘the boys’ caught up to the victim, Mikaele was already beating on the victim and they joined in the assault. After beating the victim, they left him unconscious on the ground.
Furthermore, the witness explained that “he and the McDonald’s security guards tried to break off the suspects but they turned on them and acted like they were challenging them to a fight.” At that point, he contacted the police station for assistance. The witness also told the officers that the group of men who beat up the victim left when they saw the victim had passed out.
After interviewing the witness, the officers proceeded back to the nightclub where the witness stated the suspects headed after the assault. Upon arrival at the night club, two of the guys mentioned by the witness were sitting on the fence in front of the bar. Both men were apprehended and placed in the police unit to be transported to the TPS for further investigation.
Upon arrival at the TPS, Mikaele was Mirandized where he understood and agreed to provide a statement and answer questions.
Mikaele confessed to assaulting the victim. He stated that he and his friends chased down the victim after he punched one of his friends in the nightclub parking lot. He explained that he and his friends and cousins chased the victim towards McDonald’s where they caught up with him and initiated the beating. He admitted that he threw the victim’s head with a beer bottle and proceeded to assault the victim with no hesitation.
Moreover, Mikaele stated that all his friends and cousins were involved in assaulting the victim. He also mentioned that the only person he could remember next to him during the assault was Jacob Sala, who was also punching and kicking the victim.
Authorities were able to speak with another witness (#2) who claimed he witnessed everything from afar — from his cousin being hit with a beer bottle by the victim, and fainting. He said that his sister came and took his cousin that had fainted with her. He said while he wasn’t involved in the victim’s assault, he did see his friends and cousins punching and kicking the victim.
Miakaele was later booked and confined at the Tafuna Correctional Facility to await the next available sitting of the District Court. Witness #2 was released to go home.
Authorities later followed up on the victim at the LBJ Emergency Room and were able to get a verbal statement from him.
The victim stated that disturbance started when one of the guys punched him outside of the bar while he was smoking. He claimed that the guy (friend of the suspects) punched him and he did not react back until later on before the bar closed.
He stated that he saw the same guy who tried to instigate a fight with him again so he walked up to him and hit him with a beer bottle. After that, he was chased down by the friends of the guy he hit where they beat him up until he lost consciousness. The victim stated that he could barely remember anything at the time he was hit on the head.
Mikaele is identified as a 26-year-old citizen of Samoa whereas Jacob Sala is a 35-year-old U.S National.
